{"id":7141,"date":"2025-08-04T21:09:00","date_gmt":"2025-08-04T19:09:00","guid":{"rendered":"https:\/\/lexysadvocaten.nl\/?p=7141"},"modified":"2025-10-07T22:55:55","modified_gmt":"2025-10-07T20:55:55","slug":"falsified-evidence-in-trial-leads-to-litigation-costs-order-of-over-e25k","status":"publish","type":"post","link":"https:\/\/lexysadvocaten.nl\/en\/falsified-evidence-in-trial-leads-to-litigation-costs-order-of-over-e25k\/","title":{"rendered":"Falsified evidence in trial leads to litigation costs order of over \u20ac25k"},"content":{"rendered":"<h1>Falsified evidence in trial leads to litigation costs order of over \u20ac25k<\/h1>\n<p>In a <a href=\"https:\/\/lexysadvocaten.nl\/en\/porsche-buyer-violates-duty-of-truth\/\">previous blog post<\/a> on the violation of the duty of truth (Article 21 Rv) was written: <em>\u201cIf you fool the judge, you will go down on your face.\u201d.<\/em> That was no idle boast. If you knowingly provide inaccurate or incomplete information in proceedings, you run a serious risk of a hefty award of costs. This was also experienced by two caf\u00e9 owners who wanted to buy a property they had been renting part of for years. The caf\u00e9 owners thought they could get their rights by means of a handwritten deed of sale, but it turned out to be forged, and they paid dearly for it. This emerged from a ruling by the Amsterdam District Court this summer (ECLI:NL:RBAMS:2025:4591<a href=\"https:\/\/uitspraken.rechtspraak.nl\/details?id=ECLI:NL:RBAMS:2025:4591\" target=\"_blank\" rel=\"noopener\">ECLI:NL:RBAMS:2025:4591<\/a>). <a href=\"https:\/\/lexysadvocaten.nl\/en\/services\/jurisdictions\/procedural-law\/\">Trial lawyer<\/a>\u00a0<a href=\"https:\/\/lexysadvocaten.nl\/en\/teamlid\/robert-van-ewijk\/\">Robert van Ewijk<\/a> explains what the consequences were.<\/p>\n<h2>Cafe owners want to buy rental property<\/h2>\n<p>The two caf\u00e9 owners had been renting premises in which they operated their caf\u00e9 for many years. In September 2023, when one of the owners had already died, an attempt was made to transfer the property at the notary. However, it could not be completed because the deceased's heirs had to cooperate and an executor had yet to be appointed to the estate. In the same month, at the request of the other co-owner and one of his heirs, a handwritten purchase agreement was drawn up. This purchase agreement was backdated to February 5, 2023. This document was signed by the caf\u00e9 owners and by the (non-deceased) co-owner. Curiously, this agreement also has a signature by the co-owner who died in June 2023. Finally, in December 2023, the other co-owner died.<\/p>\n<h2>Seizure and claim for delivery<\/h2>\n<p>The caf\u00e9 owners laid in May 2024 <a href=\"https:\/\/lexysadvocaten.nl\/en\/jurisdictions\/collection-attachment-and-execution\/prejudgment-attachment\/\">prejudgment attachment<\/a> on the property. They demanded that the heirs (and executors) cooperate in delivering the property. The owners' heirs and executors of the estate refused to cooperate in the delivery. According to them, the document was retrospective and the signature of one of the (deceased) owners was forged.<\/p>\n<h2>Signature turns out to be fake<\/h2>\n<p>In the court proceedings, the caf\u00e9 owners presented the handwritten document as valid proof of a legally valid sale. Thus, they maintained that a deal had been made before the landlords' death. The heirs and executors concluded that the document was not only antedated but also contained a forged signature of one of the now deceased co-owners. The caf\u00e9 owners knew that the co-owner had died and the signature could not be genuine. This made it clear that a false picture had been deliberately presented to the court.<\/p>\n<h2>Breach of duty of truth<\/h2>\n<p>The court determines that the caf\u00e9 owners did indeed violate <a href=\"https:\/\/wetten.overheid.nl\/BWBR0001827\/2025-03-08\/#BoekEerste_TiteldeelEerste_AfdelingDerde_Artikel21\" target=\"_blank\" rel=\"noopener\">article 21 Rv<\/a>, which determines:<\/p>\n<blockquote><p><em>\u201cThe parties are obliged to state the facts relevant to the decision fully and truthfully. If this obligation is not complied with, the court may draw the inference it deems advisable.\u201d<\/em><\/p><\/blockquote>\n<p>Those who fail to do so run the risk that the court will attach consequences for that violation. And that is what happened here.<\/p>\n<p>The court concludes that the false presentation of an antedated document with forged signature is not only a breach of the duty of truth, but also <a href=\"https:\/\/lexysadvocaten.nl\/en\/jurisdictions\/liability\/wrongful-act\/\">unlawful conduct<\/a> yields.<\/p>\n<h2>hefty litigation cost order for forger<\/h2>\n<p>Although the plaintiffs (the pub owners) withdrew most of their claim during the proceedings, the other party still wanted an order for costs. It requested that the actual costs <a href=\"https:\/\/lexysadvocaten.nl\/en\/jurisdictions\/procedural-law\/who-pays-the-cost-of-litigation\/\">legal costs<\/a> to be reimbursed instead of the usual <a href=\"https:\/\/www.rechtspraak.nl\/Voor-advocaten-en-juristen\/Reglementen-procedures-en-formulieren\/Civiel\/tarieven-kosten-vergoedingen\/Paginas\/Liquidatietarief-2024.aspx\" target=\"_blank\" rel=\"noopener\">liquidation rates<\/a>. The court went along with this, as a sanction for violating the duty of truth. In total, the plaintiffs must reimburse over \u20ac25,000 in costs.<\/p>\n<p>So using falsified evidence is always inadvisable. With <a href=\"https:\/\/lexysadvocaten.nl\/en\/unlawful-evidence-in-civil-proceedings-is-often-just-allowed\/\">illegally obtained evidence<\/a> may be different.
