Effective Jan. 1, 2023, the legal interest increased to 4%. That is at Royal decree disclosed. Although the statutory rate can be adjusted every six months, this is the first change in the interest rate since 2015, when the former rate was set at 2%.

Determining legal interest

In setting the legal interest rate, a connection is made with the European Central Bank's refinancing rate as in effect at the end of April and the end of October each year. That interest rate is then increased by a surcharge of 2.25 percentage points and then rounded up. Furthermore, the change in the interest rate cannot exceed 2 percentage points. This is done to prevent excessive changes in the interest rate.

When does statutory interest apply?

Statutory interest does not always apply. Sometimes the statutory commercial interest can be counted on a monetary claim, whether the contractual interest. Which interest rate applies can be read in this item.
