General

Lexys Advocaten B.V. (hereinafter: Lexys Lawyers) respects your personal data and ensures that personal information provided to us or otherwise obtained is kept confidential. Personal data refers to any information about a person. Data that indirectly says something about someone is also personal data. The following implements the information obligation laid down in the AVG to the data subject(s) whose personal data Lexys Advocaten processes.

Controller and communication

Lexys Advocaten processes personal data in order to offer services, improve services and to communicate personally with you as a data subject. To evaluate our services, Lexys Advocaten often engages a third party. As a data subject, you can choose to participate and leave your personal data behind. You can also register to receive a newsletter or other forms of communication from Lexys Advocaten.

Purpose of processing personal data

Lexys Lawyers processes the personal data mentioned below exclusively for the purposes mentioned below:

What personal data are processed?

Lexys Lawyers processes the following (types or categories) of personal data for the purpose of providing services or provided by the data subject on his or her own initiative: 

  • information necessary for a lawyer to handle your case
  • data entered on online contact forms
  • data about your surfing behavior on our website
  • the IP address of the equipment you are using
  • data obtained by us through public platforms or registers such as the Chamber of Commerce and the Land Registry

The aforementioned personal data are processed by Lexys Lawyers because they have been provided by you as a data subject on your own initiative, have been obtained in the context of the provision of services, have been made known to us by third parties, including counterparties, or have become known through public sources.

Basis of processing personal data

Lexys Lawyers processes the personal data mentioned above exclusively on the grounds mentioned below as referred to in Article 6 of the AVG: 

  • legal obligation
  • performance of a contract
  • consent obtained from data subject(s)
  • legitimate interest

Sharing personal data with third parties 

Lexys Advocaten only shares your personal data with third parties to the extent necessary to provide services in accordance with the aforementioned purposes. This includes, for example, the substitution of the practice by another lawyer, the performance of an expertise study or the engagement of another third party on behalf of and at the instruction of Lexys Advocaten, such as an IT-supplier, but also the provision of your personal data in connection with (legal) proceedings or correspondence with the other party. 

In addition, Lexys Lawyers may provide personal information to a third party, such as a regulator or other body vested with public authority, to the extent there is a legal obligation to do so.

With the third party that processes your personal data on behalf of and at the instruction of Lexys Advocaten, a processing agreement will be concluded, obliging this third party to comply with the AVG as well. Third parties engaged by Lexys Advocaten, who offer services as processors, are responsible for the (further) processing of your personal data. This could be an accountant, notary, other third party engaged for a second opinion or expert report.    

Personal data security

Lexys Advocaten attaches great value to the security and protection of your personal data and, taking into account the state of the art, ensures appropriate technical and organizational measures to guarantee a security level appropriate to the risk. In case Lexys Advocaten makes use of the services of third parties, such as an IT-supplier, Lexys Advocaten will, within the framework of the protection of personal data, agree on adequate security measures in a processor's agreement.

Retention of personal data

Lexys Lawyers does not retain personal data being processed longer than necessary for the aforementioned purposes of data processing or as required by laws and regulations.

Privacy rights of data subjects 

A request for inspection, correction, restriction, opposition, transferability of data, deletion of your personal data or withdrawal of previously given consent, can be sent via the contact details below. You will receive further notice from us within four weeks of receiving your request.

There may be circumstances in which Lexys Lawyers cannot or cannot fully comply with your request as a data subject. These include the duty of confidentiality of lawyers and legal retention periods.

In order to make sure that we provide the relevant personal data to the right person on the basis of your request, we ask you to submit a copy of a valid passport, driver's license or ID card with a protected passport photo and BSN number for verification purposes. Lexys Lawyers will only process requests that relate to your own personal data.

Use of social media 

The website(s) of Lexys Lawyers (www.lexysadvocaten.nl) include buttons (also called buttons) and/or links to promote or share web pages on social (media) networks or third-party websites, such as Twitter, Linkedin, Instagram or Facebook. Lexys Lawyers does not monitor and is not responsible for the processing of your personal data by and through such third parties. Your use of those media is therefore at your own risk. Before using those third-party services, it is advisable to read the privacy policy of those third parties.

Statistics and cookies 

Lexys Lawyers keeps usage data of the website(s) for statistical purposes. Personal data collected in this way are in principle anonymous and will not be sold by Lexys Advocaten to third parties. 

In order to increase the ease of use of the Lexys Advocaten website(s), so called ‘cookies’ are used. On the website(s), Lexys Lawyers provides a blog or forum that is freely accessible. All information posted on it can be read by anyone, i.e. any third party. A request to remove personal data from a blog or forum can be submitted via the contact details under ‘Privacy rights of data subjects’. Lexys Lawyers is in some cases unable to remove personal data from a blog or forum. In a response to your aforementioned request, Lexys Lawyers will then indicate that it has not been successful and also for what reason. In case you as a data subject post personal data via a third party application (via social media), that third party or the administrator of the application is the point of contact for such requests for removal or other privacy questions.    

Privacy policy update

Lexys Lawyers has the right to change the content of this privacy policy at any time without prior notice. Adjustments to the privacy policy will be published on the law firm's website. Therefore, please consult our website(s) regularly.
