New ROZ lease agreement for 290 business space
For so-called 290 business premises - which includes cafes, stores and restaurants - the Real Estate Council (ROZ) developed a new model lease in December 2022. The last version dated back to 2012 and has now been adapted to recent developments in laws and regulations. Opening hours in ROZ model rental agreement
In early 2022, the Shopping Hours Act amended. Because of the change in the law, a landlord can only enforce that his tenant is or is not open at certain times, only if the tenant explicitly agrees. Therefore, the new ROZ model now includes an article devoted to the opening hours of the leased property.
ROZ rental agreement takes into account Environment Act
The 2022 Model Retail Lease Agreement also includes an arrangement for when the Environment Act will take effect. There is much to be done about this law: its introduction is not without difficulty and has already been postponed several times. The new model lease agreement already takes into account that terms in the lease agreement do not correspond exactly to terms in the Environment Act. Therefore, the model states that terms that do not correspond to the Environment Act must be assigned a meaning that corresponds as much as possible to the meaning that the term in question had before the introduction of the Environment Act.

The ROZ model has also been updated to current times with how the agreement can be signed. It now includes an optional provision that regulates that the parties agree to the agreement being signed digitally.
